Dec-ember 18. — Inless the National Fair and Exposition Association, within five days from the entry of the order which the Empire" Racing Association filed yesterday at White Plains, files a bond for 0,000 the Empire City race track will be turned over to the Empire City Racing Association, of which James Butler is the president. The National Fair Association obtained a lease of the big race track between Yonkers and Mount Vernon for live years for the purpose of holding si Greater New York Fair and ExtMisition. but instead the Empire Association contended that it herded thousands of war horses on Hie track in violation of the terms of the lease, and a jurv brought in .1 verdict in favor of the Empire Association. The Empire City people are anxious to get the track back so they can hold running races next season, and the National directors have been trying to keep possession of the track property, worth 00,000, pending an appeal to the Ap|iellate Division. Justice Morschauser in his order of yesterday di rects that unless the bind for tSandMt is filed within f days of the motion for a stay of execution will lie denied and the track wil be turned over to Mr. Butler. It was reported that it is doubtful If the National Association will be able to get such a large bond.
