NEW VALID CANADIAN CHARTER. Ottawa. Out.. June 27. — The establishment of another new race track in Ontario is assured by the decision of Judge Middleton that the Ottawa racing charter is valid. This case was brought by P.. H. Hepburn. M. P.. and his associates, who are understood to include iapt. W. J. lress of the Ottawa Stable, and former manager Albert Rohr-ba.k of the Cnnaught Park Jockey Club. The claim was that the charter, which had been sold to them by the Connaught Park Club, was valueless for their purposes and they asked for damages on that ■! I —at The decision of the suit was that thev wore not damaged. ;is the charter was valid and. though they technically lost the action, they really got a verdict they desired more than a judgment against the vendors. Several offers have been made for the purchase of the charter from them, aud it is stated that assurances have been received from the Ontario government that the charter will be recognized if used for the operation of a new course. This must under the arrangement with the vendors lie somewhere beyond a hundred miles from the city of Ottawa, so that Connaught Park is safe from any competition and, it is understood, that what is desired is to open a third track near Windsor. The requirement that it must be within three miles of a Canadian city of at least 15.000 people stands in the way of a location at Fort Krie.
