: t i : • I j | TEXT OF MARYLAND BILL ♦ 1 Drastic Terms of Hall-Byrn Bill Against Racetrack Betting. . , , If Passed by Both Branches of Legislature Will Take Effect June 1, 1922. ■ ♦ ■ — Daily Racing Form displays herewith the complete text of the drastic Hall Byrn anti-racetrack betting bili. which has been passed to third reading in the Maryland House of Delegates, and is now before the Maryland senate at Annapolis. The bill is extreme, providing heavy fine and imprisonment for all forms of iiookniaking "with or without writing." and would undoubtedly cripple racing in Maryland if adopted. If passed it will take affect June 1. Here is the Hall-Byru measure in full: A BILL ENTITLED AN ACT to repeal Sections 217. 818, -10. 220 and — — 1 of Article 27 of the Annotated Code of the Public General law*, entitled "Crimes and Punishments." sub-title "Gaining:" also to repeal Section 275 of Article 2 of the Code of Public Ixu-al Laws of Maryland, title "Anne Arundel Ceunty." sub-title "Gaming," as the same was enacted by Chapter S8f .if the Acts of the General Assembly of Maryland of 1898: also to repeal Chapter 888 of the Acts of the General Assembler Maryland of 1*!°.; and also to reach] Chapters 77 and 132 of the Acts of the General Assembly of Maryland of 1912; and also to repeal section 80 of Chapter 120 of the Acts of the General Assembly of Maryland of 1880; and also to repeal Chapters 88 and 284 of the Acts of the General Assembly of Maryland of EPS: and also to repeal Chapters 872 and 273 of the Acts of the General Assembly of Maryland of 1920. and also to re-cmict Section 217 of Article 27 of the Annotated Code of the Public General Laws, entitled "Crimes and Punishments." sub-title "Gaming," with amendments. Section I. Be it enacted by the General Assembly of Maryland. That Sections 217. 218. 219. S88 and 221 of Article 27 of the Annotated Code of the Public Geueral Laws, entitled "Crimes and Punishments," sub-title "Gaming." and Section 27.". of Article 2 of the Code of Public Local Laws of Maryland, title "Anne Arundel County," sub-title "Gaming." as the same was enacted by Chapter 290 of the Acts of the General Assembly of Maryland of 1888; and Chapter 888 of the Acts of the General Assembly of Maryland of 1888; and Chapters 77 and 132 of the Acts of the General Assembly of Maryland of 1912: and Section 88, Chapter 120 of the Acts of the Gen-oral Assembly of Maryland of 1900: and Chapters S9 and 884 of the Acts of the General Assembly of Maryland of 1918: and Chapters 272 and 273 of the Acts of the General Assembly of Maryland of 1920. be and the same are hereby repealed. aud that Section 217 of Article 27 of the An-noted Code of the public General Laws, entitled "Crimes and Punishments." sub-title "Gaming." 1m? re-enacted with amendments to read as follows: 217. Any person or corporation that engages iu the selling of what is commonly known as a pool, or any interest or share in such pool, or shall make or take what is commonly known as a book, or shall engage in what is coiunionly known as bookmaking. either with or without writing, at any time or place: or any person or corporation which keeps or occupies any room, shed, tenement, tent, booth, or building, float or vessel, or any part thereof, or which occupies any place or stand of any kind upon any public or private grounds within this State, with book. papers, apparatus or paraphernalia, for the purpose of recording or registering bets or wagers. or making books or of selling pools, and any person or corporation which records or registers bets or wagers or sells pools or books, with or without writing, upon the result of any lot, chance, casually, unknown or contingent event whatsoever: or any person who receives, registers, records, or forwards, or purports, or pre-t"iids to receive, register, record or forward, in any manner whatsoever, any money, thing at ecn-sidoration of value, bet or wagered, or offered for the purpose of being bet or wagered, or for any other purpose, or sell pools upon any such result: or any person or corporation which being the owner, lessee, or occupant of any room. shed. tenement, tent, booth or building, float or vessel, or part thereof, or of any ground within this State, knowingly permits the same to be used or occupied for any of these purposes, or thereiu keeps, exhibits or employs any device or apparatus for the purpose of recording or registering such bets or wagers or the selling of such pool;, or becomes the custodian or depository for gain, hire or reward of any money, property or thing of value, stake, wager or pledge, or to be staked, wagered or pledged upon any such result: or any person or corporation which aids, assists or abets in any manner in any of said acts, which are hereby forbidden, is guilty of a misdemeanor, and. upon conviction, shall be punishable by a fine of .$.00.00 for the first offense, and for each subsequent offense shall be punishable by imprisonment in the House of Correction for not less than six months, and no longer than two years, in the discretion of the a Court: and any corporation of this State convicted of offending against this section shall be dissolved thereby and its corporate franchise shall " thereby become forfeited and void. Sec. 2. And be it further enacted. That all !! civil and criminal proce-diugs pending at the .. time of the passage of this Act shall iu no wav be affected by this Act. Sec. 3. And be it further enacted. That all other Acts of the General or Loral Laws inconsistent with this Act. be and the same are hereby _ repealed. Sec 4. And be it further enacted.
