PROTEST PAYMENT OF BREEDERS PRIZES IN RE ¬ CENT BAY MEADOWS RACE SAN MATEO Calif Nov 3 Owner Louis Almgren of the Highland Springs Stock Farm whose Smoky Snyder won the Cali ¬ fornia Homebred Stakes October 25 has protested the payment of 875 to the breed ¬ ers of the first second and third horses in that race raceAlmgren Almgren claims that when the original conditions of the race were drawn up noth ¬ ing was included to indicate that any monies would go to the breeders It is reported that the changed conditions were not posted in the secretarys office until about one week before the running of the event eventIt It develops that the change in conditions was brought about by Henry Potter Russell northern representative of the California Horse Racing Board and Almgren contends that he did not agree to any such change in conditions Russell had two horses entered in the race raceThe The original conditions of the California Homebred Stakes as taken from the stake book read as follows followsBy By subscription of 5 each to accompany the nomination To remain eligible the fol ¬ lowing cash payments are required Jan 15 1938 5 ach and Aug 15 1938 10 each Starters to pay 100 each to the winner The California Jockey Club to add 5000 of which 1000 goes to second 500 to third and 250 to fourth All nominations and starting fees to the winner Weight 122 pounds Starters must be named through the entry box the day before the race at the usual closing time but only those passing the scales will be eligible to start startCharles Charles E Cooper owner of Rancho San Luis Rey received 500 for being the breeder of Smoky Snyder Rancho Casitas got 250 for breeding Alex the Great which finished second and John W Marchbank 125 for breeding Dunfrese which finished third
