NO REQUEST FOR DATES WAS MADE. Empire City Associations Letter to Jockey Club Merely a Notification. New York, July 17. It was learned today that the Empire City Club has not made application for dates. The letter received by the Jockey Club did not request anything. According to an authentic source, the letter was merely to the effect that a license had been granted by the State Racing Commission and announced the intention of the Empire City Association to hold a meeting. Hence, there was nothing upon which the Jockey Club could act. Had there been it is probable that some action would have been taken at the meeting yesterday. As one of the officials stated, "the letter contained nothing tangible. It simply asked nothing." There Is no question that the Jockey Club would consider the matter. If it were put up to the organization in a proper manner, as there are many things to consider in connection with a race meeting which have to be thoroughly understood. J. Russell Soley, counsel for the Empire City Association through all the litigation in the matter, says the enforcement of the Jockey Club rules concerning unrecognized meetings would mean boycott, and the Empire City Association would .find ready relief in the state law. He further contends that the Jockey Club would be liable under the laws covering boycotts to become entangled in innumerable individual suits for damages if horsemen who may be outlawed bring suit. The liability of the stewards and members of the Jockey Club is limited, but, it Is said, that the members Individually would be liable for prosecution for conspiracy should the plan decided on by the stewards be carried out. , t ! . r s a i 1 1 !- r ? s t n
