VIRGINIA RACING IS SECURE DISMISSAL OF INDICTMENTS AGAINST JAMESTOWN LAYERS FINALLY SETTLES MATTER. Is Third Decision to Hold that Method of Wagering at Norfolk Track Involves No Violation of the Virginia Anti-Bookmakinjr Statute. Norfolk. V:u, April 17. in Virginia scored a decided victory on Saturday night when Justice Carmine dismissed all of the twelve indictments recently returned by the Norfolk County grand jury for a further and final test of the Virginia auti-bookmaking statutes in connection with betting on the Jamestown Jockey Clubs track. The indictments included two against the racing association represented by James E. Prince as president; two against Bob Levy as lessee of the track, and one each against eight layers. Much interest centered in the outcome, and there was a large crowd present at the trial. The case was hard fought throughout, but the defense offered no testimony, resting its ease entirely upon the states evidence, which they alleged to be insullici-ent. There was no evidence to show actual violations of the statute as construed by Magistrate Carmine. The slate is without appeal and there can lie no further molestation of the present meeting, which will terminate April 20. This action of Justice Carmine is in harmony with tin; previous "decision of his colleague, Magistrate llaekus, that the mode of letting at the Jamestown Irack is not a violation of the statute against gambling, poolselliug and bookinaking. The decision will have a sweeping effect oil racing In this state. In Virginia, particularly in this section of the state, racing is warmly advocated by the business men, boards of trade, hankers, brokers and hotel keepers. Men who were anxious to patronize the course T either as speculators or layers have been holding, back as they did not care to become involved in the; meshes of the law? The program offered by the Jamestown Jockey Club this afternoon was. in its original shape, a fairly good one. but when the horsemen: got through scratching, it had been riddled. Seven of the ten entered In the third race -were scratched, while three of the seven in the fourth race were withdrawn, six in the fifth and eight in the sixth. The racing was fairly good, a majority of the finishes finding the. winners under hard drives. The going was still lumpy and in spots it was deep and holding. Under the circumstances the talent fared well, the winners in all but the second race finding strong supiwrt. Two of them, Capsize and High Private, were favorites. Babbler, at 2 to 5. and Baby Wolf, at 7 to 10. were among the beaten favorites. The tightest finish of the afternoon came with the running of the second race, in which Ajwlogize beat .Sin lik a head. This- was the race in which Babbler started. Smirk showed a fine, turn of speed in the early stages and led until the closing strides, when Apologize managed to get his head in front. Live Wire was supposeil to be a "good tiling" in his race, but proved a disapiwintnicnt. He broke well enough, but sulked and at no time during the running would, he move up to the leaders, although he appeared to be going along easily enough. High Private led throughout, but at the end ho had to be hard ridden to stall off determined opposition from The Cohlen Butterlly. which made a determined effort in the stretch. Little Olsen let go her head at a critical moment when he drew his whip, and the filly stumbled. Had he been content to keep hand riding. The Golden Butterlly might have beaten High Private. At all events the hitters victory was not the easy thing ids connections looked for. During the running of tin second race James Blute acted as starting Judge. Frank Gardner belug relieved of his duties so as to enable him to saddle Babbler. Several of the horsemen racing here have on-iiouneed their intention of shipping to Louisville at ilie conclusion of the Pimlico meeting. Among them is James Fitzsininions, who will ship the good three-year-olds Via Octavia and Sandhill to Churchill Downs. Jockey MeCahey will accompany Mr. Fitzsininions. Antenor came out of his last race a lame horse. The colt spread his foot during the running and will be on the shelf for a month or six weeks. Mortimer Mahouey will leave for Louisville tomorrow to inspect the machines used at Churchill Downs for puri-mutucl betting. There will be three niutuel machines in use at Pimlico this spring, while they will be used exclusively at Woodbine track. Toronto.
