MONTANA DECISION IS FAVORABLE. Butte, Mont.. October 0. In District Judge Bo-lairs court the demurrer to the complaint was sustained in the case against William Gemmell, charged with making and recording a bet on a horse race. The defendant was accused of violating the law by lKtting after there had been more than thirty days f racing this vear in Silver Bow County, fifteen days on the course of the Butte Driving Club and seventeen davs on the track of the Butte Jockey Club. The court upheld the contention of the defense that there was no violation of the law, and that betting on races could be conducted legally for thirty days i-ieh in as many inclosures as might bo conducted In :i iDtin tv, so long as the betting did not exceed thirty dars in any one inclosure.
