MORE MADDEN MARES FOR FRANCE. New York, November 24,-Tlie success achieved by the produce of twenty-two broodmares shipped to France a couple of years ago by John E. Madden has induced him to plan for sending a like number of matrons to the same country. The shipment will bo made at an early date. ... The collection is composed of mares distinguished for their racing qualities, and their sons and daughters have won many of Americas important fixtures. Mr. Madden will retain four of the band and race the produce under his own colors on the French turf. JAMESTOWN CHARTER SUIT IS ON. Hearing Begins at Norfolk on Proceedings Instigated by Governor Mann of Virginia. Norfolk, Va November 24. Trial of the quo warranto proceedings brought by the state of Virginia for revocation of the charter of the Jamestown Jockey Club, and aimed at the life of the Jamestown track, was begun today before Judge J. F. West, named especially by Governor Mann to try the case. A demurrer was offered by the defense, which if sustained would throw tbe whole action out of court and forestall the aim of the governor, which is said to be the securing of a decision from a circuit judge that book-making as conducted at the Jamestown track Is in violation of the Virginia statutes. The point made by counsel for the racing management in his demurrer tiled this morning was that the Jamestown Jockey Club is not authorized in its charter to conduct or permit bookmaking or gambling in any form; that its charter can only be revoked for violation or misuse of rights given the corporation therein and that if it has done something in violation of the criminal laws, the criminal courts are the place for prosecution of such violations, and there can be no revocation of its charter in a civil action upon the allegation that it has done something its charter does not permit. The court will give a decision upon the demurrer after Assistant District Attorney General R. B. Davis and J S. Smith, for the prosecution, shall have submitted arguments for the state.
