THE GRADERS STAKE RACE WINS THE FRANK FEHR STAKES IN A CLOandK FINISH WITH GROVEK HUGHES. Frigerio Defeats Sedan with Ease and Approaches Harry Kellys Class — A Small Scandal in Connection with a Race Decarci Off. l/ uisvillc, Ky.. May 24. — The Grader, owned by .1. T. l,ooney of Lexington, won the Frank Fchr Stakes in impressive ladiioii over Grovor Hughes and Cipsey George, tart the victory did not set the horses owner any considerable sum. lor lie was advanced from an enteri d price of ,000 to ,405 by former jockey .1. Henry. Mr. Ixioney retained The i ruder with tlie customary advance. The Grader was by far the best in the race and, as in the Claik Handicap, was the victim of poor racing luck that forced liim to travel extremely wide and lose much round, lie stood the final drive in rare stylo ami got up in the last few strides to overhaul G rover I lux lies, which had enjoyed a prominent ixisition from the rise of the barrier. Gipsey George which landed in third place, would have bee* more dangerous hut for swerving sharply in the stretch. W. 11. Rakers Fltaula loomed up strongly this afternoon as a contender for Harry Kellys juv-enne crown, by the imiiressive fashion in which he took Sedans measure. He forced him at a hi nrthrcaking pace for the first three-eighths, then drew out to win with the utmost ease. The early hard eff.u-t to which Sedan had been put, was rcs|H usible for his failure to run to a place. Norumboga landing second money and Midway third. Sultry air. heat and an overcast sky all afternoon, were responsible for a falling off in attendance, but the excellent sport resulted, many of the finishes lieing close. Speculation was again of goodly volume ami as most of the best-backed horses were successful the public had a profitable inning. It develops that at yesterdays meeting of the Kentucky State Itaciug Commission, a protest was made against the action of secretary W. 11. Pearce in decliring off the Derby Consolation Iurse of U .!» Investigation disclosed that an effort to pad entries for the race had been made and that owner .1. S. Ward, who had nominated Dodge for that race, regarded his colts winning chances with such certainty that he had promised accepting 00 of the purse mid leaving S.SOO to bo split among the other three entries. The entries for the race in addition to Dodge wore .John Bonny, Thornwood and Lady Worthiugton. Trainer William Wallace, who trains Poekichoo, was also requested to enter that horse and was made the 00 proposition. but ho declined to enter into any such arrangement although urged strongly by .1. T. Weaver, the trainer of Thornwood. The commission referred the matter to the local stewards, Messrs. Grainger and Price, who questioned Messrs. Weaver, Ward. Vitatoe. Spence and Wallace on the subject. and they admitted the facts of the ease. The stewards held that there was no rule to cover the cane, but will make a rejiort to tiie commission covering the- investigation at the next meeting, to lie held at Douglas Park in June. It is practically certain that the commission will promulgate a rule to cover future incidents of similar character. The Baker establishment made it a double for the afternoon when Sleeth raced home in advance of the others in the fifth race, for which he was the favorite. Before departing tact night for Chicago. Thomas Carey owner of the Hawthorne track, where racing is contemplated next summer, stated that in all probability Messrs. Thomas J. Clay and K. C. Hopper would lie the judges and that his choice for the starter was James Milton. He said he would use every effort to have the opening day deferred until July 14 or IB. W. K. Phillips, who has liecn serving at Churchill Downs as patrol judge, has been apiHiiuted to a similar position at Douglas Park. Jockey Kedcris was suspended for five days by the stewards in the fifth race for rough riding. Aldebaran lieiug a sufferer by his action. Work-outs this morning with the track fast were: A. M.
