COURT REVERSES MARYLAND COMMISSION ON OIALONE BALTIMORE Md Oct 28 Judge Eu ¬ gene ODunne today reversed the action ol the Maryland State Racing Commission ic ruling off Thomas Malone for alleged par ¬ ticipation in the Bye Bye Will ringing al Pimlico last spring and remanded the casi to hearingIn the commission for a new hearing In making his decision Judge ODunm said I take it that nobody would be mor anxious to do full justice than the Maryland Racing Commission but I want to see thai someone Is punished for jerjury if perjurj has been committed In the long run it wil still more enhance the reputation of th racing communityIn commission in the community In the hearing which began yesterday Malone contended that his horse Uallno which was said to have been substituted foi Bye Bye Will was in New York at the time It had been claimed that the horse substi ¬ tuted for Bye Bye Will bore the marks oi the firing iron and Dr Eugene Sullivan ol Saratoga testified that Uallno never had been fired firedYesterday Yesterday jockey John Gilbert testified that Marshall Cassidy New York steward had forced him to make false statement against Malone under threat of being barred from riding Gilbert said he had ridder Uallno at Belmont Park May 4 in a race and May 7 the day of the alleged ringing he worked the horse in New York
