Commission Rulings RulingsReported Reported to DAILY RACING FORM FAIR GROUNDS Detroit Mich May 21 Racing Commissioner Louis L Brcdin issued the following im ¬ portant addition to rule 165 of Ihe rules of Michigan Racing Commis ¬ sion governing stimulation stimulationWhen When a positive report has been received by the commission from the laboratory on a winner of a race the stewards may accept the report as prima facie evidence that the horse has been stimulated and shall immediately order the purse for ¬ feited placing the horse which fin ¬ ished second as the winner and mov ¬ ing the other horses up in the order of the finish They shall also set a date for a hearing at the earliest possible moment and notify the owner trainer and any others whom in their discretion they might deem essential All such persons shall be notified in writing of the date and hour of the meeting and further notified that such constitutional rights will be amply protected and that they may be accompanied by counsel of they so desire desireTending Tending this hearing the stable shall remain in good standing and no order of suspension shall be en ¬ tered against any one connected with the stable until the stewards reach their final decision This does not in any manner relieve the licensed trainer of responsibility for the con ¬ dition of his horse and if the stew ¬ ards believe the trainer had been negligent in the care of his horse they may fine or suspend him at their discretion even if they fail to establish proof of guilt or guilty knowledge of the stimulating of the horse No ruling of any Mnd How ¬ ever shall be made on a mere pre ¬ sumption of guilt guiltBredin Bredin also announced a revision of the rules of the state to provide for the use of the consolation Daily Double payoff in the event of a late withdrawal from the second race of the Daily Double
