SUES TO ENFORCE AN ALLEGED CONTRACT. Brighton Beach Racing Association Anxious to Buy an Interest in Its Leased Land. New York, January 12. The Brighton Beach Racing Association- has brought suit against Elizabeth B. Engeman, daughter of the late George II. Enge-mau, to compel her as executrix of the estate of her father, to fulfill the terms of a contract to sell the association certain lands at Coiiey Island. January 14, 1901, according to the attorneys for the plaintiff, George H. Engeman entered into a contract to sell to the association a one-fifth interest. In the real estate, the price to be 0,000 and the title to pass December 1, 1904. The real estate Involved Is the Brighton track and land surrounding it. Miss Engeman, through her attorney,, asked for a further bill of particulars, insisting that the alleged contract was fraudulent, as it was made at n time when George II. Engeman was a confirmed Inebriate and incapable of transacting business. She also asked to have a look lit the books or the association, claiming that the entries might show only a lease of the property. Luke A. Stapleion and Charles II. Hyde are attorneys for the plaintltT and the case Is being argued before Justice Kelly of the Supreme Court in Brooklyn.
