June 1.— The appeal of the State Racing Commission from the judgment of tlie Kenton Countv Circuit Court, holding the act of the leg-Islatare creating tlie commission invalid, is now m the hands of the judges of the Court of Appeals. I lie printed brief of the attorneys representing tlie l.atonia Agricultural Association, which contested the commissions power to prohibit hookmaking at the Latonia track, was filed in the states highest court today and the complete records are now before the court. The bulges will act on the appeals at their pleasure, but it is expected an earlv deeislou will be reached.
