TERMS OF A FENDING BILL DESIGNED TO AUTHORIZE RACING IN THE STATE OF ILLINOIS All who are interested In racing are probably aware of the fact that a bill is pending in the Illinois senate which has lor Its purpose the restoration of racing in Illinois under the sanction of law The bill is printed hi full herewith Inspection of its provisions will disclose that its passage by the legislature will iiiit be conclusive If it becomes a law it docs noc go into effect in any county until the voters of that county have voted in favor of its becoming In force and that voting must be done at a general election This is applying the principle of local option to racing If the majority of the voters of a county desire racing they can have It If they du not they can exclude It This all seems fair enough and such a novel popcsition is Interesting InterestingIn In the meantime the bill is only pending and has not passed If the friends of racing desire its enact ¬ ment into law it might be conducive to favorable action H they would write to the senators representing the district of their residence and give expression to their desire for the passage of the bill It is their con ¬ stitutional right to do this when they feel so Inclined The fiftyone senators who have this matter at their disposal the numbers of their districts and their places of residence are herewith given although while the to establish a Sjtate Commission with authority to license incorporated associations1 hold race meetings and to make rules and regula ¬ tions governing pauii and repealing any and all Acts or parts thereof contrary to any and all parts of this Act Article 1 Section 1 Be it enacted by the People of the State of Illinois represented in the General Assembly That a commission which shall be styled the State Racing Commission shall lie appointed by the Governor with the advice and consent of the Senate SenateSec Sec 2 The Governor shall appoint five persons one of whom shall be familiar with trotting horses one with running horses one farmer and two business men each shall hold otfice for the term of six years or until their successors are appointed and qualify That as s xm as this Act shall he Ill force and effect the Governor shall immediately appoint two persons for six years two persons for four years and one person for two years Tho members so appointed shall select one of the mem ¬ bers to act as president the person so selected to act as president shall be president until his term of otlice shall expire Provided the General Assembly shall appropriate sufficient funds for the support and maintenance of this commission until such time as it shall be selfsupporting selfsupportingArticle Article II Section 1 No person shall he eligible to bold a commissionship except as provided in article I or any otlice or position under this Act who is directly or indirectly interested in any racing association race horses trainers jockeys drivers or any person firm company or corporation deal ¬ ing manufacturing or controlling any or all mate ¬ rial of any kind used or to be need by any asso ¬ ciation licensed under this Act And the Governor shall remove from office any commissioner officer or employee who is found guilty of receiving di ¬ rectly or indirectly any commissions interest or gratuity of any kind from any source whatsoever except as provided in this Act ActArticle Article III Section 1 Before entering upon tho duties of his ollce each of said commissioners and the secretary shall make and subscribe and file with the Secretary of State an affidavit in the fol ¬ lowing form formI I do solemnly swear that I will support the constitution of the State of Illinois and I will faithfully discharge the duties of the commissioner or secretarv of the State Racing Commission ac ¬ cording to the best of my ability and keep this Act free from all causes of just criticism and at ¬ tacks tacksSec Sec 2 Each commissioner shall receive for his services five thousand 5000 dollars per annum annumSec Sec Said commissioners shall appoint as sec ¬ retary a person of good repute with business ability Said secretary shall perform any and all duties said commissioners shall assign him Snid secre ¬ tary shall receive a salary not to exceed three thousand OOO dollars per annum annumSec Sec 4 Said commissioners shall have power to appoint all necessary employees for the purpose of carrying out the provisions of this Act ActArticle Article IV Section 1 Said commissioners slrill provide all nocessarv bnoks and keep a true faith ¬ ful and correct record of all proceedings Such hooks shall be open to the public at all times and a complete annual report shall bo made to the Governor and the Senate by said commissioners commissionersSec Sec 2 The yeas ami nays shall be taken and entered nn the record of all proceedings of said commissioners upon any and all questions questionsSec Sec Said commissioners shall have power to make additional rules and regulations not provided for In this Act for the proper conduct of every rare meeting authorized under this Act and may Investigate any and all nets of any licensed as ¬ sociation authorized by vlrtuo of this Act or the conduct of person or persons and shall have the right to enter orders rules or penalties and to revoke any license justified after such investigations investigationsArticle Article V Section 1 It shall be the duty of said commission to issue a license to any corporation Incorixirated under tin laws of the State of Illinois for the purpose of conducting running or harness raring meetings In the order of their incorporation Such license and corporation shall bo subjected to all provisions of this Act any and all rules and regulations made or passed by said commission commissionSec Sec 2 It shall be unlawful for any person firm or corporation lo conduct or bold any racing meeting of any kind anywhere In this State until first duly Incorporated and received a have been complied with and an additional license shall be issued to a corporation for each 500000 population rliv h coinrty But at no firm shall two running horse race meet or two harness horse race meet be allowed on the same days lq any one county or within tjjmccutimyArticle a radius of fifty miles of each tjjmccutimy Article VIII Section 1 Said commission shall apportion equally the legal days of racing permitted i under this Act between all duly licensed racing associations without discrimination discriminationSec Sec 2 Said commission shall not allow or per ¬ mit any association or corporation to conduct a horse race meeting for a longer time than thirty 30 days for each association In any one year Sec yearSec Said commission shall have the right to refuse a license to any corporation whose officers or directors after an investigation are proven not to be men of honor and integrity Any association refused a license shall have the right to appeal to the Circuit Court of the county in which said association desired to locate Further appeal shall be allowed to a higher court by either party partyArticle Article IX Section 1 Every association licensed under this Act shall charge each and every person a minimum admittance fee to the race track and stands of one dollar 100 a smaller fee to be fixed by said commission may be permitted for harness horse race meetings or fairs Said asso ¬ ciation shall pay to the treasurer of tho State of Illinois every thirty days ten per cent 10 pet of each and every dollar so collected and a detailed statement of the receipts of each association shall lie sent to the State Racing Commission every thirty days daysSec Sec 2 When a racing association has received a license to conduct a racing meeting it shall pro ¬ vide an additional enclosure where shall be permit ¬ ted automatic registering machines in the care of the necessary competent attendants who shall act as temporary custodians of moneys deposited by persons and all moneys so deposited shall be sub ¬ jected to reasonable rules and regulations made and passed by said racing commissioners No other method shall be permitted Each association shall cause to be collected five per cent from all sums deposited and no more moreSec Sec II No person shall he permitted to enter tliis additional enclosure unless they are over twentyone years of age Each association shall cause to be paid by each and every person an additional admittance fee of one dollar 100 Ten per cent of all moneys so collected shall be paid by the association to the treasurer of the State of Illinois every thirty days and a detailed statement of the receipts of each association slmil be sent the State Racing Commission every thirty days i iSec Sec 4 Any association its officers or directors violating any part of or violating the whole of Article IX shall be subject to a penalty of a fine of five thousand dollars or from one to five years in tho State penitentiary or both for each offense Provided however liona fide representatives of the press and mcmliors of said racing commission and its secretary shall have access to any and all parts of the grounds without cost and only absolutely necessary employees shall be permitted to go to their respected positions on the grounds without cost and no others othersArticle Article X Section 1 Any county or State Fair Association in the State of Illinois may make ap ¬ plication to said State Baclng Commission to ac ¬ cept or take advantage of any part of or all pro ¬ visions of this Act and said county or State Fair Association shall state in writing what section or provision of this Act they elect to accept and said State Racing Commission after a thorough investi ¬ gation of said written application shall Issue a license to said Slate or county fair so far as it Implies to the part of this Act that the said State or county association elect to accept and said State or county fair association by such acceptance shall be subjected to all the rules and regulations of such racing commission and all provisions and penalties for failure of said State or county fair association to faithfully comply with any and all parts or provisions of this Act as accepted acceptedArticle Article XI Section 1 It shall bo unlawful for any person to solicit ask make induce or attempt to induce any other person or persons to vvager money security or anything of value on a horse or horse race anywhere inside or upon any part of tho property or grounds of any licensed racing as ¬ sociation It shall bo unlawful for any person to take or receive directly or indirectly money so curlt or anything of value from any other person or persons for the purprise of wagering or placing money security or thing of value for said other person or persons cxcept as otherwise provided for in this Act ActSec Sec 2 It shall bo unlawful for any person to act as a commissioner for tho purpose of solicit ¬ ing money security or thing of value from fornnlns or ninles any when on tho promises or grounds of said association Each and every person violating any part of Article XI shall be ixpellod from tho enclosure or grounds and bo sublcct to arrest and a penalty of two thousand 2000 dollartr for each and every offense Continued on second page TERMS OF A PENDING RACING BILL Continued from first page Sec Said commissioners shall enforce to the strict letter of the law all provisions of Article XI XISec Sec 4 Said commission shall have the author ¬ ity to exclude any and all undesirable persons from entering the ground of any racing association li ¬ censed under this Act Article XII Section 1 No association licensed under this Act shall remit or vacate any tines or penalties imposed upon any trainer driver owiicr jockey or attendant uuder the jurisdiction of said association associationArticle Article XIII Section 1 Any and all persons dis ¬ satisfied with any rUle regulation or order imposid by the directors or olUeers or employees of said racing association shall have the right to appeal to said racing commission further appeal may be had to the Circuit Court of such county In which such appeal has been taken Further appeals shall be allowed The said racing commission shall have equal rights as to appeals appealsArticle Article XIV Section 1 The State Treasurer of the State of Illinois shall honor all checks or vouch ¬ ers of the State Uaclng Commissioners signed by the president and Secretary for salaries aud ex ¬ penses of the said commission from the funds re ¬ ceived from the provisions of this Act And all the surplus money shall be used for building aud maintaining Jiard roads under the control of the State Highways Commission CommissionArticle Article XV Section 1 Any Act or part of an Act now in force or effect coutraryrto any part of this Act is hereby repealed repealedThis This Act or any part thereof shall be without force or effect in any county in this State unless the following provisions have Itceh observed observedFirst First Whenever onehalf per cent of one per cent of the legal voters tesiding within the county desiring to adopt this Act shall petition the county clerk to submit the proposition whether or not this Act shall be in force or effect in the county hi which the petitioners reside it shall be the duty of the county clerk to submit such proposition at the next general election Provided that such petition shall ibe presented to said county clerk lio t less than fifteen days before such general elec ¬ tion Provided however this Act shall not be submitted to the voters more often than once in any calendar year in the same county countySecond Second The proposition so to be voted on shall be on a separate ballot aud shall read as follows Shall all the provisions of an Act to create a State Racing Commission with authority to license incorporated associa ¬ tions to hold race meetings and to make rules and reg ¬ ulations governing same and repealing any and all Acts or narts hereof contrary to any and all parts of this Act become operative in the county countyof of State of ofIllinois Illinois Third And if it shall appear that a majority of the voters of such county so voting upon the question shall have voted In favor of the question then all the public authorities of such county and State shall give their consent and make all neces ¬ sary arrangements to carry out the provision of this Act
