. SUIT OVER SATINMORE TORONTO, OnL. Feb. 20. In October, 1021. Robert Newell, horseman of Toronto, sold his thoroughbred horse Satinmore to William Russell for 00. He was paid 00 down and 00 later. He is now suing for the balance. Before Judge Morson in Toronto, Russell contended that he is exempt from further payment under the terms of an agreement which called for a cash payment of 00 and two payments of 00 each out of the first and third purses won by the horse in 1922. It is on this document that Russell claims exemption from paying the balance of 00, because the horse did not secure a third purse in 1922. Judge Morson in reserving judgment pointed out that the price agreed upon was 00 and that the agreement only specified the mode of payment.
