BERK S STATEMENT OF HIS CASE. He denies the charges lodged against him. says that he does not even know Grand and a.-. -uses two id hi- loiim-i clerks, discharged by him for alleged irreuulari ties, of framing up a job on him. Berk says that the father of one of th se clerks threatened that his .-on would make startling disclosures unless he was restored to his position. This Berk says he refused tA do. whereui»oii the charges were made rto presiding Judge Hamilton. The latter look up the sheets on several races and after inspect ing them decided that Berk and Ciand were both guilty. Tnless reinstated neither will be allowed to operate on the eastern trucks.
