CLAIMING RULE PROVISIONS Joseph A Murphy Clears Up Mis ¬ understanding on Michigans Law Open Claiming Rule DETROIT Mich May 15 Joseph A Mur ¬ phy director of racing of the Detroit Rac ¬ ing Association today cleared up what seemed to be some misunderstanding over the claiming rule adopted by the Michigan Racing Commission Under the rule any stable racing at the time in the state of Michigan through its owner or authorized agent is entitled to claim any horse except his own in a claiming race All other per ¬ sons were required to take out a license with the state racing commission the license fee being 25 25This This in no sense nullifies the open claim ¬ ing rule the intention being to give the stewards of the track an opportunity to know in advance who might be claiming a horse and whether his standing on the turf was such that he was entitled to such a privilege It was also intended to prevent if possible the claiming of horses simply for the purpose of shipping them to some other race track by parties who were irresponsi ¬ ble or without sufficient standing on the turf Last year Bill Orange was claimed out of a race here and it was at least a week before anyone knew what had become of the horse or who had claimed him himUnder Under the rule after a horse has been claimed it can not be sold by private treaty for a period of sixty days It may however be claimed out of any race either by the original owner or anyone else and this in no manner acts as a bar to its starting in races This is practically the same as the rule in other places except that the period of prohibition here is sixty days instead of thirty as it is in some jurisdictions
