ASKS THAT INDICTMENTS BE QUASHED. Judge Hart Will Hear Arguments In Tennessee Betting Cases This Afternoon. Nashville. Tenn., January 4. In the Criminal Court J. M. Anderson, attorney for William Gerst, Jr., and William Hayes, indicted on a charge of bkmiiklnff and betting on a race nt.Oumberlniiij Park last Saturday in violation of tlie anti-betting law passed by the last legislature, filed n motion to quash the indictments on the ground that the law is unconstitutional. In his motion Judge Anderson pleads that the presentment shows that at the time of the alleged bet or wager Hayes was a licensed bookmaker and said bet or wager was made by him on the result of a race run on a licensed track, that the act of 1903 is invalid under Article 2, Section 15, of the constitution, which provides that no bill shall become a law which embraces more than one subject to be expressed in its face, and that the act of 1905 embraces other subjects separate and distinct from gambling or races. Gerst is charged with having bet and Hayes with betting 0. Judge Hart will hear arguments on ine motion to quash Friday afternoon.
