DRAKE AND HAYMAN AREFTNED2t0 "EACH. Stewards Hold That a Bule of Racing Was Violated in the Wes Transaction. Saratoga, N. Y., August 22. After Wes was beaten for the fifth race on Monday, both George S. Davis and M. L. Hay man put in a claim for him. In the toss-up Hayman got the horse. The claiming price was ,4C0. This would make Wes a cheap horse, but there was a strong belief that Haymans claim was of the friendly order, and this belief was verified when it was announced yesterday that the horse had been returned to John A. Drakes stable. Today, however, Messrs. Drake and Hayman were forcibly awakened to the fact that the act had been in violation of a rule of racing when the following official order was promulgated by the stewards: "In compliance with the resolution adopted at a meeting of the stewards of the Jockey Club held June 4, 1000, the stewards of the Saratoga meeting hereby fine John A. Drake and M. L. Hayman 00 each for Infringement of section six, rule 131 of the rules of racing." The resolution referred to as having. been.adopted-on June 4, was an aftermath of the transaction in which W. S. Price was alleged to have received tribute from Paul J. Ralney with the understanding that Price would in future not bid up or claim the horses of Ralney In selling races. Section C of Rule 131 reads: "Any person who shall attempt to prevent another person from bidding on the winner of a selling race or claiming any horse in such race, or demand any portion of the surplus from the owners of horses which are entitled to it, or any owner running in selling races who may make any agreement for the protection of each others horses in contravention of these rules, shall be fined, suspended or rule1 off." The- stewards investigated the transfer .of Wes and declared it irregular, notwithstanding that Hayman claimed to have resold the horse to Drake at a profit.
