DELMAR CLUB GRANTED AN APPEAL. Ouster Case Will Now Have a Rehearing in the United States Supreme Court. Jefferson City, Mo., January 5. — Chief Justice Gantt, of the Supreme Court, has granted a writ of error to the Supreme Court of the United States iu the ouster suit of the State against the Pelniar Jockey Club. Application for the writ was made by former Judge Bond, the clubs attorney, on the ground that the Pelmar Jockey Club was being deprived of its property without due process of law, in violation of the federal constitution. The Missouri Supreme Court a month ago declared the clubs charter revoked because it had held only racing meets, and had held no agricultural fair, as required by the charter.
