LATONIAS APPARENTLY SECURE POSITION. In explanation of the official statement made Sat urclav. that the La tenia Jockey Clubs spring meeting will iHisitively be held with Imokmakiiig. no matter what may be the decision of the Kentucky Court of Appeals in the pending appeal case at issue between the Latonia Jockey Club and the Kentucky State Racing Commission. President Harvey Myers, of the Latonia Jockey flub, said: "I wish to say that the commission stands absolutely enjoined from in any wise interfering with our meet ing or with anybody connected with our track or engaged ill racing on the track. This sweeping injunction includes any interference with jockeys, trainers, owners, bookmakers or oilier- who are there for the purpose of participat ing in racing events. That injunction remains fully in force until the Court of Appeals tinallv acts ution the question. I have every confidence that the La tonia Jockey Club is right in its contention and will eventually win. but von niav sav that even if the CBM should be ultimately lost by the Jockey flub, there can be no question of its right to hold its spring meeting without any interference whatever from the commission. The case is now set for argument on the 5th of May. and. even if it should lie submitted without briefs on that date, it is not likely that the opinion would be rendered for ten or fifteen days at least thereafter, and it might be a much longer period. But. conceding that it should be rendered fifteen days afterward, that would take it over the latter part of May. and no judgment of the Court of Appeals becomes final until the lapse of thirty days, exclusive of Sundays, after the rendition of the opinion. Of course, either side may file a petition for rehearing, which would necessarily lengthen this time until the court could act upon that petition. Thus it will la- seen that even if the court should ultimately decide against Latonia and I dont believe it will the decision would not be come effective and the injunction would remain in full force and effect until after the termination of the meeting, which begins on May 2."."
