RACING MEASURE NOW BEFORE THE ILLINOIS STATE LEGISLATURE Senator John Denvir of Chicago who recently introduced in the state senate at Spring ¬ field a racing measure which if passed and enacted into law will permanently restore racing in Illinois has kindly forwarded to Daily Racing Form a copy of the bill which calls for a racing commission and legalizes the use of parimutuels Here is the complete text of the Denvir measure A bill for an act to establish a state racing commission with authority to license incor ¬ porated associations to hold race meetings and to make rules and regulations govern ¬ ing same and repealing any and all acts or parts thereof contrary to any and all I parts of this act actSection Section 1 Be it enacted by the people of the State of Illinois represented in the gen ¬ eral assembly There is hereby created in the department of agriculture a state rac ¬ ing commission consisting of three members The governor shall appoint as commissioners one of the presidents of the racing associa ¬ tions licensed under this act and one of the presidents of the incorporated fairs of this state and one of the presidents of the Thor ¬ oughbred Horse Breeders Association of this state The governor shall appoint one mem ¬ ber to hold office for three years one for two years and one for one year and there ¬ after the term of each commissioner shall be three years and until their successors are appointed and qualify This act shall be administered by the State Racing Commis ¬ sion created by this act and in its name without any direction supervision or con ¬ trol by the director of agriculture A ma ¬ jority of the commission shall constitute a quorum No commissioner shall receive for his services any remuneration whatsoever whatsoeverPOAVEK POAVEK OF COMMISSION COMMISSIONSection Section 2 The said commission shall ap ¬ point as secretary a person of good repute with business ability Said secretary shall perform any and all duties the said commis ¬ sion shall assign him The said commission shall have power to appoint and remove in ¬ cluding the secretary all necessary employes in the office of the State Racing Commission and fix their salaries and expenses for the purpose of carrying out the provisions of this act The said commission shall provide headquarters and all necessary books and keep a true and correct record of the pro ¬ ceeding and a complete annual report shall be made to the governor and the general assembly The commissioners shall have power to make all additional rules and regu ¬ lations not provided for in this act for the proper and successful conducting of every racing meeting authorized by this act and may investigate any and all acts of any li ¬ censed association authorized by this act and the conduct of persons or publications and shall have the right and authority to enter orders rules or penalties after such hearing or investigation Any association person or publication may appeal from all decisions to the Circuit Court in the district in which the appellant may reside resideSection Section 3 It shall be the duty of the commissioners to issue a license to any cor ¬ poration incorporated under the laws of the State of Illinois for the purpose of conduct I ing running horse racing meetings in the order of their incorporation dating on or after October 15th 1922 Such license and corporation shall be subject to all provisions of this act and any and all rules and regula ¬ tions made or passed by said commission It shall be unlawful for any person firm or corporation to conduct or hold any running horse racing meeting of any kind anywhere in this state until first duly incorporated under the laws of the State of Illinois and receive a license from the State Racing I Commission It shall be unlawful for any j person firm or corporation to conduct any j horse racing meeting on the seventh 7th day j of the week commonly called Sunday after dark or between the first day of October and the first day of May succeeding It shall be lawful for said commission to issue a license to one corporation to conduct a running horse racing meeting in this state for I each two million persons after all provisions of this act have been complied with and an additional license shall be issued to one corporation for each additional 500000 popu ¬ lation Said commission shall apportion equally the legal days of racing permitted under this act between all duly licensed rac ing associations without discrimination but no corporation shall be allowed more than i thirty racing days in each year yearTAX TAX FOR GOOD KOADS Section 4 Every association licensed un der this act shall charge each and every person a niimirnum admittance fee to the race track of one dollar 100 A smaller fee to he fixed by said commission may be permitted for harness horse race meetings or fairs Said association shall pay to the Treasurer of the State of Illinois thirty days after each race meeting ten per cent 10 of each and every dollar so collected and a detailed statement of the receipts of each as sociation shall he sent to the state racing commission every thirty days All such moneys shall be used to maintain hard roads within the State of Illinois IllinoisSection Section 5 When a racing association has received a license to conduct a racing meeting it shall be permitted to install automatic registering machines in the care of the necessary competent attendants who shall act as temporary custodians of money de ¬ posited by persons and all moneys so de ¬ posited shall be subjected to reasonable rules and regulations made and passed by said racing commission No other method shall be permitted Each association shall never retain more than three per cent 3 from such sums deposited depositedSection Section G The provisions of this act shall not apply to fair associations or harness horse associations unless any incorporated fair or harness horse racing association in the State of Illinois make application to said State Racing Commission to accept all the provisions of this act and said fair or harness horse racing association shall state in writing that they desire to accept the pro ¬ visions of this act and said State Racing Commission after an investigation of said written application shall issue a license to said fair or harness horse racing association and by such acceptance they shall be sub ¬ ject to all the rules and regulations of such Racing Commission and all provisions and penalties for failure of said association to faithfully comply with any and all parts or provisions of this act as accepted acceptedBETTIXG BETTIXG RESTRICTIONS RESTRICTIONSSection Section 7 It shall be unlawful for any person to solicit ask make induce or at ¬ tempt to induce any other person or persons to wager money security or anything of value on a horse or horse race anywhere inside or upon any part of the property or grounds of any licensed racing association It shall be unlawful for any person to act as a commissioner for the purpose of solicit ¬ ing money security or thing of value from persons anywhere on the premises or grounds of said association Each and every person violating any part of Section 7 shall be expelled from the inclosure or grounds and be subject to arrest and each offense shall be a misdcameanor but no provision of this act or any act now or hereafter in force or effect shall be so construed as to prohibit friendly wagers between indi ¬ viduals Said commission shall have the authority to exclude any and all undesirable persons from entering the ground of any racing associations licensed under this act Any act or part of an act now in force or effect contrary to any part of this act is hereby repealed repealedLOCAL LOCAL OPTION PROVISIONS PROVISIONSSection Section 5 of this act shall be without force of effect in any county in this state unless the following provisions have been observed First Whenever onehalf per cent of one per cent of the legal voters residing within the county desiring to adopt Section 5 of this act shall petition the county clerk to submit the proposition whether or not Sec ¬ tion 5 of this act shall be in force or effect in the county in which the petitioners re ¬ side it shall be the duty of the county clerk to submit such proposition at the next countrywide election Provided that such petition shall be presented to said county slerk not less than fifteen days before such countywide election Provided however this proposal shall not be submitted to the voters more often than once in any calen ¬ dar year in the same county countyShall Shall all the provisions of Sec ¬ tion 5 of an act to create a state racing commission with authority to license then all the public authorities of such county and state shall give their con ¬ sent and make all necessary arrangements to carry out the provisions of this act actThis This act shall never be repealed or amended unless such proposed repeal or amendment has first been submitted to a vote of the people of such county within which is located such racing association I
