Shapoff, owner of Compact, lodged a claim for Theo Red in the second race, but it was declared invalid by the stewards on the ground that he ran Compact in a -condition unfit for racing and for the purpose of claiming only. Shapoff had been warned by the stewards not to again start Compact unless she was fit to. race. Ignoring this admonition, he was fined- 50 and tho further entry of Compact refused.
