COMMUNIST IS DISQUALIFIED » . Unusual Incidents Feature Days Sport at Empire City. . ♦ Portden Takes Headliner From Spoilt Beauty and General A. — Rosengarten Unseated in Third. 9 YONKERS, N. Y.. July 17.— Portden, from the Geneseo Stable, was the winner of the overnight race that held the feature position on the Empire City Association card today, when he scored in a five and three-quarters furlong dash for plateis. It was a close finish, with Spoilt Beauty, from the B. B. Stable, second, and James Kellys General A. was a close third. The racing of the day was marked by a disqualification and a fall when Communist was set back in the second race, and in the third Phyllis Ann unseated Rosengarten. This accident robbed the apprentice of a mount on Portden. He wanted to ride, but the track physician ordered him to stay on the ground. Then, just before the running of the fourth race, when a notice was posted that the OConnor baby had been found "alive and O. K," it brough more applause from the racing crowd than the finish of any race of the afternoon. In this sprint, that went to Portden, the start was a bit straggling, with Pinluck first to show from the stalls. He was closely attended by Spoilt Beauty, and the filly soon displaced him in the lead. Humphries, who had been substituted for Rosengarten on Portden, soon had him racing within striking distance of Spoilt Beauty, while General A., the choice of the field, was off slowly and forced to race on the outside. It was not until the stretch turn was reached that Portden had caught Spoilt Beauty and, as he drew alongside the filly, she hung on well. General A. had raced wide to reach third place, and he was coming with a rush, but he could not make it and Portden was safely past the line winner by half a length, while Spoilt Beauty had saved second place by a head. The three were a full six lengths before Flying Charger, the one to finish in fourth place. A disqualification marred the second race, a five and a half furlongs dash for plater juveniles when Dr. J. P. Jones* Communist, after leading Mrs. Parker Comings Easy Flight over the line in a driving finish, was set back for stretch interference, and the race was awarded Easy Flight. This ruling moved Mrs. Paul J. Fox Dunfox into second place and third went to Masked Revue. In the run through the stretch Communist had come up on the outside of Easy Flight, and while he went over slightly there did not seem to be any actual interference. The stewards sent for Rosengarten, who rode Easy Flight, and after hearing him there was a lengthy discussion before the ruling was announced. The stewards had not disqualified Communist alone for his bearing in through the stretch, but they charged he had seriously bumped and interfered with Manual in the running and that was taken into consideration in the ruling. Little Rosengarten, after having had his mount declared winner in the second by the disqualification of Communist in the second race, had a fall with Bert Blumes Phyllis Ann in the third race. This was a five furlongs dash, for cheap two-year-olds, and Phyllis Ann was caught in close quarters and bumped going to the first turn, Continued on twenty-fourth page. Rosens Palasa, which came away easily in in the stretch to win going away by three lengths from Mrs. Richard Hermans Khela-boo, and R. E. Bentons Togo beat Balapin for third. Right at the break Recital stumbled so badly that he had no chance, and then the piling up of horses, in which Rosengarten met with his accident, prevented the race from being a truly run one. After unseating her jockey, Phyllis Ann continued racing through the field, and she interfered not a little with some of the other runners.
