CASE OF MISTAKEN IDENTITY How a Living Colt Was Taken for forOne One Which Died Much Trouble TroubleInvolved Involved in Eectifying Error LEXINGTON Ky July 19 A twoyear old chestnut colt the property of Dan Chap pell noted attorney of Miami Fla being trained by R Robertson and known in the stable as Peter Feu and purchased as by Pot au Feu from Lady Stimulus was not permitted to start because his markings did not coincide with those on the certificate of foal registration Through the efforts of Thomas B Cromwell this colt has been identified as by Burgoo King from Lybia Both colts were purchased by J L Cleve ¬ land owner of Mintwood Farm Lexington and they came up for sale in October 1937 as weanlings at Lexington sales paddock paddockApplication Application for registration of both colts had been made but certificates of registra ¬ tion has not been received by the sale com ¬ pany and the markings were not included in the sale catalog Both were chestnuts both had blaze faces and some other white marks Their resemblance was such that when the numbers were off the hips of the colts the men at Mintwood Farm got them confused and when the Pot au Feu colt died during the winter a report of the death of the Bur ¬ goo King colt was sent to The Jockey Club The living colt was entered by Mr Cleveland in the Lexington sales October 1938 as a yearling and sold as being by Pot au Feu from Lady Stimulus Mrs S T Games of Louisville bought him and later sold him to Dan Chappell ChappellNEVER NEVER CHECKED REGISTRATION REGISTRATIONThe The certificates of registration have been in the hands of Mr Cleveland since Novem ¬ ber 1937 but for some reason or another he had never checked them and when Mrs Games bought the colt no check was made after the certificate was transferred to heri and the same was true in the case of Mr Chappell It remained for the New England Racing Commission to discover the discrep ¬ ancy ancyCromwell Cromwell secured photographs from Chris ¬ topher D Moore breeder of the Lady Stimu ¬ lus colt taken when he was a weanling and Mr Chappell sent him photographs of the JLybia colt These were put before Mr Cleveland and he very readily recognized the pictures of the colt he sold at Lexington as of the colt he thought was from Lady Stimulus StimulusThe The next step was a search by Mr Cleve ¬ land among his papers for the certificate of the Burgoo King Lybia colt The marks of the certificate checked exactly with those of the colt which has all this time been called Peter Feu Cleveland and Chris Moore made affidavits concerning the mixup which have been forwarded to The Jockey Club In the expectation that the matter will be cleared up and the Burgoo King colt can start under a new name and under a proper identification
