COMMISSION TO FIGHT TO A FINISH. Lexington. Kr., November 14. Messrs. J. P. Chinn, E. F. Clay. Milton Young and Louis des Cognets of the State Racing Commission, met with Attornev General Breathit and attorneys Lewis Mc-Quown, J. C. W. Beckham and Morgan Chinn here this afternoon and prepared affidavits to controvert those filed by the Latonia Jockey Club in the case attacking, the constitutional right of the commission to prescribe methods under which betting may be done on race tracks in this state. The affidavits will be filed in the circuit court at Covington during the coming week. The commission has decided to prosecute the fight to a finish, which means that the case will go to the Court of Appeals and the attorneys today expressed themselves as being entirely confident that the decision -will be -to the favor of the commission. Cars were set on the siding at Elmendorf Farm tonight for twenty-eight thoroughbred mares, which are to leave for England Monday to be sold in the December sales. Albert Lewis arrived here today with Clell Turney and Maud Sigsbee of Turney Bros. string that have been out of commission in Canada since the close of the meeting at Hamilton. They were turned out in Bourbon County. The Turney stable will be shipped to Hot Springs about January 1.
