ARRESTED MEN NOT ARRAIGNED. New Orleans. La., December IS. There was no arraignment of the principals in the test of the Locke law this morning as had been expected and the throng of sporting people, who jammed the criminal court room, were disappointed. This delay was occasioned by the attorneys for Lyles. Frigerio and Sheffield filing si demand with the court on the states attorney for a bill of particulars. "There is a difference between a book and a slate." asserted Judge Richard B. Otero, of the law firm of Adams and Otero, when the case came up "and we demand to have a bill of -particulars filed by the district attorney to know just what he means by charging that our clients operated a book." In this statement is believed to have been the key to the defense which has been planned by the attorneys for the track people. They propose pinning the state down to technicalities and to differentiate -ltetweeu bookmak-ing and slate writing. The defendants were represented bv Judge Richard B. Otero, Lyonel Adams and Colonel E. Howard McCaleb. In lieu of this demand of the defense, the arraignment of Heaslip. Lyles. Frigerio and Sheffield went over until Monday. Meanwhile there is no doubt of a great shifting of sentiment in favor of a repeal of the drastic Locke lac so that racing. In mollified form and under the jurisdiction of a commission, can be carried on. A monster petition is now being circulated among the commercial interests of the city, and it is said every merchant on Canal street, except one. has signed it. asking for a repeal of the anti-racing law. The prediction is freely made here now that the law will be modified at the next session of the legislature, which, however, does not meet until 1910. That business interests have suffered here is now admitted on all sides. The hotels, restaurants and boarding houses have especially felt the absence of the race track people who usually are in tliis city In December by the thousands. S. F. Heaslip has not only resigned the presidency of the New Orleans Jockey Club, but it was announced today that at a meeting of the directory tl:o middle, of next week probably all the local directors will resign. Edward Corrigau is expected here meanwhile.
