CONSTITUTIONALITY TO BE ATTACKED. New York. September 29. John B. Stancbfield, the eminent lawyer who has been retained by the nineteen men indicted by the Kings County grand jury for alleged violation of the Hart-Aguew law. intimated when his clients were arraigned yesterday that many things might happen which would defer for a long time, perhaps forever, the trial of, the cases. Iu short, ho hinted that the constitutionality of that section of the law which relates to bookuiakiug is to be vigorously attacked iu the courts. Assistant District Attorney Elder intimated that the grand jury was still giving its spare time to race-track cases, and that a number of additional indictments might be expected ou Friday, when the grand jury niakes its final reiort. District Attorney Clarke and Assistant District Attorney Elder are not showing much of their hand to the raee-track men. Only one name appears on each indictment as a witness, but live different men furnished the testimony upon which the Indictments1 wen? found, it is thought that the five worked together and will lie called upon to corroborate each other. The method of indictment as pursued in these cases is different from that followed in the summer of 190S. In the present indictments the "man with the roll" is named first, then come his "slip writer" and rashier, according to the Assistant District Attorney Elder. The witnesses. Mr. Elder admits, are detectives employed by his otlice.
