ERR0P. IN PROGRAM CAUSES SUIT. Hamilton, int.. June 2S. — An interesting law suit is in prospect, in which the Ontario Jockey Club ia interested. Martin Malone has Ik en instructed to t"st the responsibility of the club for an error in its oflieial program. 1nder the new machine system of betting, the wagers are made by number instead of the name of the horse, under th" old bookmaking system. On the second day of the Ontario Jockey Club meeting, in some of the programs the number of Early Light, a jumper, which won his race, was given as 3ri3 instead of 3T 4, it is alleged. H. Greenway is one of the men who bet on 353 when he thought he was wagering on Early-Light. He bought six five-dollar tickets and claimed he won 40. The club refused to settle on the ground of error and he placed the matter in the hands of Martin Malone. Mr. Malone this morning received a letter from the secretary of the Jockey Club to the effect that the club was not responsible for errors on the program and could not pay out on tickets numbered 353. which were on a horse named Rhomb, that did not win. Suit will be started at once.
