V KYNE SUES FOR 0,000 SAN FRANCISCO, Calif., May 12.— A suit has been filed in the civil courts here by William P. Kyne, San Francisco sports promoter, seeking payment of an unpaid balance of 0,000 on a note for 90,000 which he holds from John W. Marchbank, said to be the heaviest stockholder in the Tan-»foran race track. The note was given to secure the purchase of Kynes interest in the track more than a year ago. An attachment of Marchbanks physical property, including his interest in the Tanforan plant, is sought. The track recently was leased to Jack P. Atkin, effective May 25. Mr. Kyne is due to leave here in the near future for Kansas City, where his Riverside Park track will open for its annual spring meeting. May 27.
