MORE ABOUT FAIR GROUNDS John P Sullivan Says Crescent City CityJockey Jockey Club Has No Bight to toSell Sell or Lease Property John P Sullivan attorney for the Louisi ¬ ana Jockey 6lub Inc gave out the follow ¬ ing statement My attention has been called by a representative of a local news ¬ paper to the statement of judge Joseph A Murphy which appeared in the New Orleans papers Friday June 8 1934 wherein judge Murphy is alleged to have submitted to his associates of the Crescent City Jockey Club Inc three alternative proposals the second of which is to sell to the highest bidder the equity which the trust now holds in the Fair Grounds property and surrender the con ¬ tract with Mr Bradley to the purchaser and ithe inquiry has been made whether judge Murphy and his associates have the right to sell the equity referred to and to surrender the contract with Mr Bradley to the purchaser purchaserI I beg to advise that the Louisiana Jockey Club has no contractual relations with a trustee or Fair Grounds trust and the Louisiana Jockey Club knows only the Cres ¬ cent City Jockey Club Inc in the Fair Grounds transaction The Fair Grounds has been leased by the Louisiana Jockey Club to the Crescent City Jockey Club The Cres ¬ cent City Jockey Club has no right to sell the lease on the Fair Grounds or deliver title thereto to any alleged purchaser Among the conditions of the lease on page 42 paragraph 22 it is expressly set forth that the lessee Crescent City Jockey Club Inc agrees and binds and obligates itself to make no sublease neither transfer nor assign said lease in whole or in part nor use the leased premises for any other pur ¬ pose than that herein contemplated horse racing exclusively without the written con ¬ sent of the lessor Louisiana Jockey Club Inc which consent of the lessor if granted shall be evidenced by supplemental authen ¬ tic act of lease leaseThe The Louisiana Jockey Club has not and will not give its consent to a transfer or as ¬ signment in whole or in part of said lease and any attempted transfer or assignment of said lease of the Fair Grounds by the Crescent City Jockey Club Inc would be null and void and of no effect and will not be recognized by the Louisiana Jockey Club
