| OPTION SYSTEM DECISION j J ONLY ON FORMAL REQUEST j ALBANY, N. Y., July 9.— Chairman Herbert Bayard Swope of the New York State Racing Commission has been requested by Attorney General John J. Bennett, Jr., to immediately file with him a formal request for an opinion on the legality of the optional system of betting now being conducted at the race meeting in progress at Syracuse, N. Y. Attorney General Bennett has prepared an opinion on the subject and is ready to make it public providing that Chairman Swope asks for an opinion. It is not customary for the attorney general to render opinions on any subject until after he has been requested to do so by a state official. Chairman Swope has neglected to file his request for a decision on the betting proposition!! the request is received by the attorney H eral tomorrow, his decision will bdH nounced immediately. a
