CASE GOES TO APPELLATE COURT. Californias Anti-Racing Law Will Be Threshed Out Late in Present Month. San Francisco. Ca!.. June 0. — The case of George Adams, arrested for alleged violation of the Walkcr-lltis law on account of having acted as stakeholder of a wager made on the result of the Kotchol-Papke light, was called in Police Judge Shortalls court and on request of attorney Carroll Cook a continuance was granted. Attorney Cook meanwhile applied for a writ of habeas corpus to Judge Cabaniss so as to test the constitutionality of the unti-guuihliug act without delay, but the judge refused to issue the writ on the ground that the questions involved atlect each and every county in the state and the case should be take* before the Appellate Court. An application for a writ was at once made to the Appellate Court, and it was made returnable June 2s. Adams bail being fixed at cash. A copy of the writ was served on Chief of Police Cook, and attorney Cook put up the money for Adams release.
