ADOPT OPEN CLAIMING REE Fair Grounds Races Now Run Under Eastern Regulations, i Any Person in Good Standing Now Eligible to Claim Horses Explanation of Conditions. , NEW ORLEANS, La., Feb. 4. Beginning with Fridays racing, all claiming races run under the auspices of the Louisiana Jockey Club will be governed by the "open" or eastern claiming regulations. This change, in which the "closed" or Kentucky rule, was dropped, was announced following a meeting of a committee of horse owners and trainers with Col. John P. Sullivan, managing director, and Joseph McLennan, racing secretary of the Louisiana Jockey Club at the Fair Grounds Wednesday afternoon. Under the "open" rule all horses participating in any claiming races are subject to claim by any one in good standing. -The Kentucky rule limits the privilege to claim to owners represented by a starter in the particular claiming race in which claim is made. In recent weeks a flood of criticism of the "closed" rule has been advanced by horsemen here, and with a majority of the western turfmen here strongly in favor of the "open" rule, appeal for its adoption in both Illinois and Kentucky may be carried to the turf governing bodies of those states. A few of the horse owners and trainers here who expressed preference for the "open" rule included -the following: R. J. Nash, T. E. Nash, J. S. Middleton, J. J. Greely, J. O. Keene, William Schmidt, Phil Reuter, Edward Haughton, B. S. Mich ell, William Irvine, S. N. Holman, C. H. Knebel-kamp, J. B. Partridge, D. A. Headley, M. Goldblatt, B. A. Jones, Cliff Porter, H. C. Riddle and others. Rules as adopted today to govern all claiming races under the jurisdiction of the Louisiana Jockey Club are as follows: In claiming races all horses running in the race are subject to claim by any.person, or his authorized agent, but for the account only of the person making the claim provided, however, that no person shall claim his own horse or cause his horse to be claimed, directly or indirectly, for his own account, nor shall any person claim more than one horse. The claiming price of each horse in a claiming race shall be printed on the program, and all claims for said horse shall be for the amount so designated. ADOPT OPEN CLAIMING RULE Continued from first page. shall be determined by lot under the direction and supervision of one or more of the stewards. All claims shall be in writing, sealed and deposited in a locked box provided for this purpose by the clerk of the course. No money shall accompany the claim. Each person desiring to make a claim must first deposit with the association the whole amount of the claim in cash, for which a receipt will be given, unless at the time of the depositing such claim he shall have such amount to his credit with the association. All claims must be deposited in the claiming box at least fifteen minutes before the time fixed for the race to begin and not later, and no official of said association shall open said box or give any information as to the filing of claims therein until after the race has been run. Immediately after the running of the race the claim box shall be opened and the claims, if any, examined in the presence and under the direction and supervision of one or more of the stewards. A horse claimed shall not be delivered by the original owner to the successful claimant until authorization be given by the clerk of the course, and every horse so claimed shall run in the interest and for the account of the owner who entered it in the race, but title to the claimed horse shall be vested in the successful claimant from the time said horse leaves the paddock for the starting post, and said successful claimant shall become the owner of. the horse, whether it be alive or dead, sound or unsound or injured during the race or after it. The stewards may, at any time in their discretion, require any person making a claim for a horse in any claiming race to make affidavit in writing that he is claiming said horse for his own or as authorized agent and not for any other person. Any person making such affidavit wilfully and falsely shall be subject to punishment in the same manner as in hereafter provided for the punishment of other persons violating any of the terms of this rule. No horse claimed out of a claiming race shall be eligible to start in any race in the name or interest of the original owner for thirty days, nor shall such horse remain in the same stable or under the care or management of its former owner or trainer, or anyone connected therewith. No person shall refuse to deliver to the person legally entitled thereto a horse claimed out of a claiming race and, furthermore, the horse in question shall be disqualified until delivery is made. No person shall offer, or enter into an agreement to claim, or attempt to prevent another person from claiming, any horse in a claiming race, nor shall any person attempt by intimidation to prevent anyone from running a horse in a race for which it is entered, nor shall any owners or trainers running horses in any claiming race make any agreement for the protection of each others horses. No person or persons shall enter, or allow to be entered in a claiming race, a horse against which any claim is held, either as a mortgage, bill of sale, or lien of any kind, unless when or before entering the horse the written consent of the holder of the claim shall be filed with the clerk of the course of the association conducting said race. No person or persons shall claim ownership in a horse after such horse has run in a claiming race in the name of another person who, at the time of said race, had peaceable and undisputed possession of said horse. This rule shall apply to all races under the jurisdiction of the Louisiana Jockey Club, Inc., including steeplechases, which are run under conditions, provided, however, that in any such steeplechase no horse shall be subject to claim except by the owners of other horses running in such race or their authorized agents, but for the account of the person making the claim. Selling races shall be discontinued, and wherever the word "selling" appears elsewhere in these rules of racing, it shall be construed to mean "claiming," unless such construction would be manifestly inapplicable. Any person violating any of the provisions of this rule shall be subject to discipline by the stewards, who may, in their discretion, punish the person so offending by fine or suspension, or by excluding such person from all places under their control for the remainder of the meeting, and said stewards shall in every case report their actions to the Louisiana Jockey Club, Inc., which may, in its discretion, exclude such person either temporarily or permanently from all race meetings under, its jurisdiction
