Merritt versus The Jockey Club and the j New York State Racing Commission will 1 a be held tomorrow at 7:30 p. m. in the State Building on Centre Street. Merritt was denied a license to ride in 1943 following • allegedly suspicious riding at Empire City the previous summer. He took the matter to the courts and Judge Carroll J. Walter $ decided that court action was admissable. 1 Recently the State Supreme Court, appel- 1 f late branch, ordered a rehearing of the case ! i before the joint board of the State Racing ! t Commission and two stewards of The | j Jockey Club. 1 This will be the first hearing of its kind I open to the public and it is understood , that Herbert Bayard Swope, chairman of I the State Commission, has expressed himself in favor of admitting the public to all such hearings. The fact that Merritt him- J self was not admitted to the original Jockey * Club hearing of his case was a prime factor in the supreme court decision. l Merritt has not been granted a license for ] 1944 pending the result of tomorrow evenings session.
