FAVORABLE DECISION IN OKLAHOMA. Gambling Laws of State Do Not Affect Bookmaking Prosecution Pushed on Another Point. Enid. Okln.. July 12. A demurrer to information c-Iiarg ng bookmakers at the local race meeting with gambling, was sustained in the County Court bv Judge J. It. Culiisoii. Before the hearing on the demurrer, the defense made an atlidavit that thev could not secure a fair trial lie fore Judge Cullison and reposed an application for a change of judge, under the new law. At the hearing on the demurrer the prosecution attempted to show that the offense was covered bv the statute on gambling. Judge Cullison held that the word "device" did not include such gambling as liookmaking. but intimated that they could be convicted on the statute covering the public peace. Deputy County Attorney Church, who is handling the cases, later filed a motion to amend the Infer mation by Inserting the statute on public peace, and the cases will be vigorously prosecuted. Races are being held and liookmaking allowed in other cities in the state, and this is considered a test case to determine whether the state; laws will cover the matter. It will probably reach the Supreme Court. I regardless of the decision in the lower court.
