TOLLESON LANDS IN JAIL Contempt of Court Brings Sentence of Thirty Days and a Fine of 50. NEW YORK, N. Y., June 19.— Roi Tolleson, who was recently connected with the ill-fated Daily Racing Star, was committed to the county jail of New York last night, for a criminal contempt, on a warrant issued by Supreme Court Justice John L. Walsh. Tolleson and his associates in the Daily Racing Star commenced to publish a series of articles early in March, 1931, in which they unjustifiably attacked Moses L. Annen-berg, Hugh E. Murray and the Morning Telegraph, Daily Racing Form and Daily Running Horse. The attacks continued daily until a suit was commenced in the Supreme Court, New York county, for an injunction to restrain the further publication of the malicious statements complained of. Mr. Justice Alfred Frankenthaler, of the Supreme Court granted such an injunction, restraining Tolleson and his associates from printing the libels and defamatory epithets. The granting of the injunction seemed to have only a momentary effect upon Tolleson. After a brief lull, he recommended the publication of these vicious articles and ridiculed, sneered at and defied the court as well. Accordingly, a motion was made to punish Tolleson for a criminal contempt and, when the matter came up before Mr. Justice Louis A. Valente, the judge was satisfied from the record that Tolleson was guilty and made an order imposing upon Tolleson a sentence of ! thirty days in the county jail and a fine of j 50. Judge Valente also fined the Equipoise Publishing Company, Inc., the pub- lisher of the Daily Racing Star, 50 for its activities in this connection. Tolleson was picked up last night at midnight by deputy sheriff Goldstein. He refused to accompany the officer at first. At one oclock he was deposited in the country jail, where he will probably have considerable opportunity and leisure to reflect on the folly of attacking the courts I and unjustly maligning the publishers.
