DOPING CASES GO TO TRIAL Jack Howard and Charles P Mitchell MitchellFace Face Judge Sullivan Accused of ofViolating Violating AntiNarcotic Laws The trial of the well known turfman Jack Howard and his Negro stable foreman Charles P Mitchell who are accused of vio ¬ lating the antinarcotic laws began Monday before Judge Phillip L Sullivan in the United States District court courtThe The case is being heard without a jury Immediately after it was called a motion was filed by William F Waugh counsel for Howard and Robert L Miller and F Joseph Donohue of Washington D C Mitchells attorneys to suppress the evidence on the grounds that Howards stables were raided without a search warrant warrantSpecial Special Assistant United States Attorney General Leslie E Salter the government prosecutor vigorously opposed the motion and put two federal narcotic agents on the stand The first witness Walter S North declared that the foreman of the Howard stable poured either liquor or powder into a syringe and shot it down the horses throat usually about fortyfive minutes be ¬ fore post time He testified that he saw Adelaide A treated thus on February 17 1933 Ebony Lady February 27 Spud Feb ¬ ruary 28 Fire Neck March 6 and Ebony Lady March 8 In each case he said the doped bangtail became extremely nervous nervousE E P Berti another narcotic agent de ¬ scribed similar scenes last year at Arlington Park He declared that Mitchell syringed Marmion July 5 1933 Islam the same day and Islam again July 12 He alleged that Louie Dear was given a hypodermic injec ¬ tion in the shoulder July 14 by Dr Nelson E Southard a veterinarian who also is under indictment and that Miss Tulsa was similarly treated July 15 and Louie Dear July 19 by another veterinarian who is not facing trial trialOthers Others under indictment are Benjamin Creech race horse owner Ivan H Parke former jockey William Payne stable man A A Baroni owner James Hexhen stable boy Hal Price Headley owner and Marvin Hardin stable boy
