MacPhail Statement Is Not Factually Correct Rinehart RinehartBOSTON BOSTON Mass June 10 D E Rine ¬ hart chairman of the Maryland Racing Commission today issued a statement here in reply to Larry MacPhail former head of Bowie who yesterday charged the com ¬ mission with being malicious and arbi ¬ trary in barring MacPhail from the Pim lico track Rineharts statement follows followsMr Mr MacPhails statement is not fac ¬ tually correct The commission has al ¬ ways felt that it was the prerogative of the management to write the condition book The Maryland Racing Commission entered into the dispute as to the cqnditipri book at Bowie at the request of Mr Mac ¬ Phail and representatives of the HBPA HBPAAs As to his suspension Mr MacPhail was notified that a hearing would be held at a given time His counsel requested an ex ¬ tension in order to give Mr MacPhail an opportunity to appear The extension was granted and later the commission was in ¬ formed by counsel for Mr MacPhail that he was unable to locate his client There ¬ fore the case was closed As to my quali ¬ fications to serve as a member of the Maryland Racing Commission I should be happy to leave that decision to the Gov ¬ ernor of the State of Maryland
