Rulings of Stewards Upheld by Commission Sustain Suspensions of Eight, Increase Two at Charles Town CHARLES TOWN, W. Va., June 1.— Action of the local stewards in suspending 10 trainers for alleged stimulation of horses here last month, has been upheld, for the most part, by the West Virginia Racing Commission in a report made public today on hearings held May 20 and 21. The commission reinstated all horses involved, sustained six-month suspensions for eight trainers and upped two suspensions to a year. The additional penalties were imposed on Victor P. Noyes and Luther Wilson, and the report reads: "They having heretofore been found guilty of the violation of the West Virginia Racing Commissions corrupt practices rules, the commission imposes an additional penalty of six months." Following the release of the report, James M. Mason m., local attorney representing the involved trainers, said he had been instructed to file a bill in the United States District Court for the Southern District of this State to enjoin the commission from the enforcement of its ruling. Mason said: "I am of the opinion that the commission is unwarranted and is clearly in violation of the constitution in adopting such a ruling." In sustaining the ruling of the stewards, the commission brought out, "If not themselves guilty, they were responsible for the condition of their horses as found by the urinalysis test." In addition to Noyes and Wilson, those affected by the upholding of the suspensions were James Stuart, G. W. Canard, Elsie S. Morris, J. E. Allison, Jr., King M. Boyd, Willie James Johnson, Frank Lewis and N. L. Brown. The horses who will be eligible to run when either sold or assigned trainers acceptable to the stewards are Ranger Mosby, Running Riot, Sunset Boy, Love My Gal, Rolling Water, Cat Eyes, Air Defense, Windy Hills, Foolish Bid and King Brand.
