KENTUCKY COMMISSION MEETS Adopts Amendments to Rules Deal ¬ ing With Stimulating Horses Holds Up License Applications of Four Rid ers Approves List of Officials for Latonin LOUISVILLE Ky May 1 Formal adoption of several amendments to the rules dealing with penalties for stimulation of horses approval of the report of its license committee and approval of officials for the Latonia Jockey Club spring meeting as sub ¬ mitted by Col M J Winn managing direc ¬ tor of that association constituted the prin ¬ cipal business transacted by the state racing commission at its regular annual preseason meeting here hereIn In approving the report of the license com ¬ mittee consisting of Charles F Price C Bruce Head and Thomas C Bradley the commission held for further consideration the applications of Lloyd Geving A Rodri ¬ guez William Day and C Compton for jockey licenses Except for only a few held up for identification of applicants arid other technicalities the committee recommended that all other applications considered in its reportbe approved approvedSeveral Several new names are included in the list of Latonia officials confirmed by the com ¬ mission Stewards for the meeting will be Charles F Price S H McMeekin Sherman Goodpaster and E H Hogge Goodpaster and McMeekin succeed C Bruce Head who will be at Washington Park and T C Bradley BradleyL L C Bogenschutz H B Lindenberger and Fred Burton were named placing judges William Hamilton starter and Bogenschutz as racing secretary and handicapper to suc ¬ ceed William Shelley who also returns to Washington Park which operates in con ¬ flict with Latonia this spring Clerk of scales duties also will be looked after by Lindenberger with Burton acting as entry clerk also J T Chawk returns as paddock judge J T Clark as patrol judge and the commission reappointed John McLaughlin as inspector of the mutuels for the year and Joe Knau as telegraph censor Clark also was approved as patrol judge at Churchill Downs DownsLindenberger Lindenberger and Burton newcomers to the Latonia staff have been associated with racing practically all their lives Linden ¬ berger has been office manager at Churchill Downs for years He is a son of John Lindenberger noted starter of the nineties Burton has been employed in the racing secretarys office at Latonia Churchill Downs Lexington and Dade Park for a number of years yearsUnder Under the amended rules applying penal ¬ ties for stimulating horses or possessing any narcotic drug the commission adopts the saliva test and makes expulsion from the turf mandatory in all cases where an own ¬ er trainer foreman groom stable employe or otherwise connected with any stable is found with any narcotic drug in his posses ¬ sion sionThe The rules also give an owner or his au ¬ thorized agent or trainer or chemist rep ¬ resenting the owner or trainer the right to a sample of the saliva specimen taken by the veterinarian of the commission and if he may so desire an analysis by a chemist of his own selection selectionShould Should the report or chemical analysis dis ¬ close a positive result indicating that a nar ¬ cotic stimulant or drug has been Adminis ¬ tered or should any chemical analysis of other excretions taken from any horse dis ¬ close beyond doubt that a stimulant or drug has been used any person so offending shall be punished at the discretion of the stew ¬ ards ardsWhen When questioned as to what decision the stewards probably would make in cases where the reports of the chemists differed judge Charles F Price presiding steward at Churchill Downs and Latonia said that ac ¬ tion will only be taken when the proof is positive This would indicate that in cases where there is a variance in the reports of the commissions chemist and the one em ¬ ployed by the owner or trainer no action would be taken takenThe The rules dealing with use or position of narcotics or stimulation are areRule Rule 240 No narcotic stimulant or drug shall be used no drenching of anything shall be administered and no electrical me ¬ chanical or other appliances other than the ordinary whip and spur shall be used for the purpose of stimulating the horse or af ¬ fecting his speed in a race Any person so offending shall be punished at the discretion of the stewards stewardsRule Rule 240A Any owner trainer foreman groom stable employe or other person con ¬ nected with any stable found with any nar ¬ cotic drug in his possession while upon the grounds of any of the tracks under the jurisdiction of the racing commission shall be ruled off and such possession shall be deemed sufficient evidence for such ruling without further proof proofRule Rule 240B The Kentucky State Racing Commission may employ a chemist for the purpose of making a chemical analysis of saliva or other excretions or body fluids taken from any horse or horses running on any track operating under a license from the Kentucky State Racing Commission CommissionThe The commission may also employ a veteri ¬ narian who shall attend the schooling of horses be in attendance at the paddock for the purpose of observing and inspecting all horses assembled therein until they shall leave the paddock for the post and also be in attendance at the starting gate in all races for the purpose of additional observa ¬ tion tionIf If as a result of such observation or in ¬ spection the veterinarian should be of the opinion that any horse in any race has been stimulated by a narcotic stimulant or drug he shall immediately report such conclusion to the stewards who may direct him to at ¬ tend such horse at its stall where he shall take a sample of the saliva of said horse for the purpose of chemical analysis analysisSuch Such procedure of sampling by the veteri ¬ narian may be witnessed by the owner or his authorized agent or irainer or chemist representing the owner or trainer of the horse fr u which a sample or samples of its saliva has been so taken Whenever it be possible the owner or his authorized agent or trainer or chemist representing the own ¬ er or trainer shall during the weighing which follows the race be notified of the impending saliva sampling He shall also upon demand be given a sample of such saliva so taken for the purpose if he so de ¬ sires of having an analysis made by a chem ¬ ist of his own selection selectionThe The veterinarian also shall as soon as possible send or deliver to the chemist designated by the Kentucky Racing Com ¬ mission a sample of such saliva for analysis and said chemist shall report to the stew ¬ ards the result thereof should the report of such chemical analysis disclose a positive result indicating that a narcotic stimulant or drug had been administered or should any chemical analysis of other excretions or body fluids taken from any horse which has run in any race disclose beyond doubt that a narcotic stimulant or drug has been used any person so offending shall be punished at the discretion of the stewards stewardsAll All applicants for licenses shall be re ¬ quired to sign the following waiver waiverI I hereby certify that I have read the fore ¬ going application and affirm that every statement contained therein is true and cor ¬ rectly set forth and I do hereby assert and agree as a condition precedent to the re ¬ ceiving of said license that the same may at any time be summarily revoked can ¬ celled or suspended or withdrawn and that the barns and living rooms used by me may ¬ be searched for the possession of narcotics without a search warrant at all times either in my presence or absence the Kentucky State Racing Commission or the officials at any track acting under its jurisdiction and I hereby waive any and all rights which I now or may hereafter have to object to any such search and waive all claims aris ¬ ing or growing out of any such search against the Kentucky State Racing Commis ¬ sion and or the members thereof the racing association on whose premises the search is made and or the officials at any track making such search searchDr Dr F H Riesler of Buechel Ky was appointed veterinarian to the stewards stewardsFrazer Frazer Lebus was the
