SPORTSMANS PARK SUIT j j TO BE HEARD ON MAY 13 j Superior Court Judge Joseph Kelly today set May 13 for the hearing of the Sportsmans Parks suit against the Illinois Racing Commission for a change in racing dates. Attorney Samuel Markman, who is handling the case for the National Jockey Club, then filed a motion to quash the record and proceedings of the Illinois Racing Commission in connection with the suit. This motion will also be heard on May 13. Sportsmans Park objected to the dates allotted by the Illinois Commission this year in which it was given eighteen racing days. Appearing before the commission, it asked for the month of October, which includes twenty-seven racing days. This objection and request for a change of dates was overruled by the commission. Sportsmans Parks attorney then appealed to Judge Kelly for a writ of certiorari, which was granted. The writ was served today and the books and records of -the racing commission produced in Judge Kellys court, the judge immediately setting May 13, for the hearing. Attorney Markman today charged that the commission had failed in its duty by allowing March 15 to pass without announcing the racing dates as prescribed by the Maypole law. Markman also charged that the commission in its decision overruling Sportsmans Parks protest, discriminated against the track, the commission ruling reading, in part: "Sportsmans Park is a one-half mile track and is not suited for the racing of the better grade race horses. And the better grade race horses do not race there." The statement was discriminatory, said Markman.
