Vincent Stott, trainer for J. B. Tingley, owner of Infinite Maid, filed a protest against the horse Wadedale, owned by the Rose-Mar Stable, winner of the fifth race at Dufferin Park on Thursday, June 20, 1946, on the grounds that the horse was not eligible under the conditions of the race, inasmuch as Wadedale had won two races since May 17, 1946. According to the records Wadedale won at Woodbine on May 29 and at Dufferin Park on June 8, 1946, therefore the purse is forfeited by Wadedale to the second horse, Infinite Maid, and the other horses moved up in the placing as follows: - Charley Bailey to second money, Nimblefoot to third money, and Circus Flag to fourth money.
