SUIT OVER DISPOSAL OF j j CONEY ISLAND TRACK ! s CINCINNATI, Ohio, June 8: Walter D. Murphy, receiver for the Cincinnati Jockey Club, Inc., filed suit in common pleas court Monday in which William V. Dwyer and the Atlas Finance Company, Ltd., Montreal, Canada, were named defendants. Murphy charges that after the Cincinnati Jockey Club, Inc., operating the .Coney Island race track, had paid 6,800 for the track, the property was turned over to another company. This move was indicated a few days ago when Murphy sought instructions from Judge Stanley Struble and asked for permission to file suit against Dwyer and the finance company. Murphy charges that the jockey club entered into a lease with Dwyer on July 8, 1933, whereby it was given privilege of purchase. According to Murphy, the club did pay the purchase price April 30, 1934. On September 4, 1935, he continues, Dwyer conveyed the real estate to the finance company. Murphy also charges that the finance company was aware at the time that the purchase price had been paid by the Cincinnati Jockey Club. In the suit Murphy asks the court to compel Dwyer or the finance company to convey the real estate to the jockey club and give a deed for the property.
