Warner, motion picture executive and race horse owner, together with the Hollywood Turf Club, John F. MacKenzie, vice-president and general manager of that organization, and a number of other individuals, yesterday were named defendants in a ,000,000 damage suit filed in Superior Court by Telefilm, Inc., a corporation which claims to have initiated and developed the process known as the "film patrol." In the complaint, Telefilm asserts that the defendants are now engaged in a scheme to wrest its business away and operate it through a new organization known as Thorobred Photo Service, Inc., a corporation, it is stated, wholly controlled by Warner. Telefilm asserts that, with the cooperation and at the invitation of the Hollywood Turf Club, it began during 1944 to develop its secret process by which every part of a horse race could be photographed and the films projected on a screen from five to seven minutes after the completion of a race. A large staff was employed to develop, perfect and operate the process, it is claimed, and the device has come into use on several major race tracks. Early this year, the complaint alleges, Warner, Mackenzie and others named, engaged in the scheme to deprive Telefilm of its business and throw it into the hands of the new company. In pursuance of this plan, it is challenged, the defendants secretly engaged the services of Telefilms technicians, thus obtaining much information concerning the operation of the process. Some of these technicians, it adds, are now employed by the Thorobred Photo Service. HOLLYWOOD PARK, Inglewood, Calif., June 11. — Jack F. Mackenzie, general manager of the Hollywood Turf Club, had no comment to make today on the accusation that he and Harry M. Warner, motion picture executive and Hollywood Park director, conspired to pirate the business of Telefilm, Inc., a company engaged in filming horse races, away from inventors of the process. Telefilm, Inc., charged in a suit filed in Superior Court, that Mackenzie and Warner are seeking to take away that companys business by setting up a rival organization, Thorobred Photo Service, Inc., said to be controlled by Warner. It is further charged that the Hollywood executives secretly engaged Telefilm crews to obtain information about its processes. Telefilm, Inc., is seeking ,000,000 damages.
