Hornbeck of the Second District Court of Appeals, has set June 30 as the date by which the State Racing Commission must answer a taxpayers suit that attempts to reduce the number of horse race meetings in Ohio. Charles P. Masterson, a Cleveland real . estate broker, filed the suit seeking a writ prohibition. Masterson charges that the commission has failed to comply with Ohio law, which bans more than one race meeting at any two tracks within 30 miles of each other simultaneously. Tracks named in the suit as located within 30 miles of each other and having coinciding dates are: Ascot Park and Painesville, June 3-JuIy Cranwood and Grand view, September 20-October 11 j Randall and Grand view, September 11 and 13, and River Downs and Lebanon, May 30 and 31. Although the dates coincide, the conflicting tracks have different racing hours. Ascot Park, Cranwood, Randall and River Downs are running race ovals and their racing programs must be concluded by 7 m. Painesville, Grandview and Lebanon night harness race courses and may operate until midnight.
