Smith Case to Highest Court NEW YORK, N. Y., May 29.— Tom Smith, suspended trainer of the Maine Chance Farm stable of Mrs. Elizabeth Graham, is carrying his case to the higher courts. His attorneys, Cahill, Gordon, Zachry and Reindel, announced today that they had served notice of a motion for leave to appeal to the New York Court of Appeals. The motion will be submitted next Monday. The pending action follows the ruling of the Appellate Division of the State Supreme Court on May 17, upholding The Jockey Club and New York State Racing Commission who approved his suspension by the stewards of The Jockey Club for a period of one year to November 2, next. Smith was held responsible for the administration of ephedrine in a nasal spray to the horse Magnnific Duel, winner of a race at Jamaica on November 1, 1945. Smith is now appealing to the highest court in the state.
