COMMISSION REPEATS REFUSAL TO DURNELL LOUISVILLE Ky May 31 Charles E Durnell internationally known horseman again failed in an attempt to obtain a trainers license under the Kentucky Racing Com ¬ mission when that body at a special session at Churchill Downs this afternoon disposed of his appeal from the disapproving action of its license committee The commision sus ¬ tained the latter board boardThe The action was the second of like character in the case 6f the veteran horseman the commission having previously approved a report of the license committee in which Durnell and others were recommended such action until Durnell could eliminate a dis ¬ approval of the New York Jockey Club ClubThe The entire commision composed of Polk Laffoon chairman William E Smith S S Combs Theodore E Mueller and Frazer Lebus attended Commissioner Smith re ¬ turned this morning from New York where it was reported he went over phases of the Durnell case with at least one member of The Jockey Club This report was not veri ¬ fied by the commission commissionAt At todays meeting the commission drafted a change in the rules to disqualify horses claimed from all stake engagements unless such are transferred by the nominator to the claimant The rule must lay over for thirty days before becoming effective
