1 1 1 ! ! . DISQUALIFICATION IN FEATURE The Fighter Set Back in Kew Garden Handicap at Jamaica. Judges Award Decision to J. Simonettis Sgt. Byrne Our Relgh and Young Native In Popular Scores. NEW YORK, N. Y.. Oct 8. While there was disappointment when Miss Merriment-was withdrawn from the Kew Gardens Handicap at Jamaica today, there came plenty of excitement in the running, when John Simonettis Sgt Byrne and the Milky Way Farms The Fighter crossed the line locked and then a claim of foul was lodged by Stout, who rode Sgt. Byrne. The photograph declared The Fighter the winner, with Sgt. Byrne second,. Mid Victorian third and Glee-man fourth. Then The Fighter was disqualified. A drizzling rain that fell in the forenoon kept the attendance down, but the track was good and plenty of interest was evidenced, even though the best race was so sadly marred. The five in the Kew Gardens sprint left on the same stride, with The Fighter and Stubbs showing the way. They were soon well clear of the others, but leaving the back stretch Stubbs came over sharply on The Fighter and caused Robertson to take .up and go to the outside of him when he was again in stride. Gleeman was racing third to the pair when, this happened and then came Mid Victorian, and Sgt. Byrne was last of the band. COSTLY INTERFERENCE. Stubbs held his lead to the stretch and as Robertson moved on him there with The Fighter he carried the son of Bull Dog out The Fighter finally had him put away and crossed to the inside, but this interference cost much. In the meantime Sgt Ryrne was racing along on the inside and Stout attempted to come through when there did not appear to be room. The son of Stimulus fought his way up -without shortening stride, but the stewards ruled there was a foul and The Fighter was set back. Stout in his claim of .foul charged" that Robertson leg-locked him in the last seventy yards. Robertson was called into the stand to defend himself against this charge and later in the day the stewards handed down a ruling. After Stout had been awarded a winning mount on Sgt Byrne in the feature race of the day, he came back with another .winner-in the second best race when he rode Mrs. John Hertz Our Reigh to victory in the mile and a furlong of the Warwick Handicap. This was a sensational score, for the reason that Our Reigh jumped in the air at the break and was virtually left, being a distant last when in motion. Corundum was off running and quickly went into a lead of three lengths, and Thor-son, as he went along in second place, was four lengths before Crystal Prince, arid into the back stretch Our Reigh was lengths back of these. There was some closing up on Corundum going to the turn from the back stretch and before the stretch was reached it was evident he was to be run down. Then Our Reigh began to make up ground on the inside. GAME PERFORMANCE. First it was Crystal Prince that joined Corundum but .he hung as he reached the son of Teddy, but Our Reigh did not hang. He fought his way by to be winner by a length, while Corundum had lasted to save the place by a length, and Thorson quit so badly he was a bad last. Frank E. Browns Jackinthebox proved best of the maiden juveniles that met in the opening five and one-half furlongs dash to win going away. Mrs. Ethel D. Jacobs Duel took the place, and third went to Alvin Un-termyers Jungle Chase, with Strabo fourth. Jungle Chase took the lead at the start and showed the way to the top of the short stretch. Jackinthebox followed him closely under slight restraint and, rounding into the short run home, he caught the son of Noah to come on handily and win by a length. Duel, after breaking slowly, steadily worked his way up and in the closing strides caught the tiring Jungle Chase. Mrs. William Russells Social Error, which has been quitting badly in all her races, was handled differently in the six furlongs of the second race and when Kastner waited back of the pace that was furnished by Flopsio she came away when called upon, to be winner by four lengths. E. A. Rileys Dedi-1 cation also ran down Flopsie, to take the place, while the finish for third was so close that a photograph was required to make the decision. The photograph disclosed that Mrs. Ethel D. Jacobs Buzzin Around also headed Flopsie to take that part of the i award. NEW TACTICS SUCCESSFUL. With a short delay at the post, Flopsie was first to show put pf the big field, but Social Error was racing closely after her and Kastner took hold of the Brooms filly as she settled into stride, and Flopsie went on. Social Error was out three lengths before, Buzzin Around and it was not until going to the stretch turn that Kastner made his move. As he did, Social Error readily raced past Flopsie, and a furlong from home was, in a clear lead, to come home winner. High Mabel, from the Orienta Stable, was an easy winner over the plater juveniles that came together in the third. This was another big field, and the place went to Warren Wrights Princess Bull when she outfinished Day Dawn for that share of the purse, with Night Watch fourth. Night Watch left the post in full flight, but she was soon joined by High Mabel, and the pair drew out into a lead of eight lengths over the others of the company. Cooper had High Mapel under slight restraint as she held her position and at the head of the stretch she had taken command. It was all over when the High Time filly stepped to the front, and her winning margin was three lengths. When the horses were going to the post for the last race, the stewards handed down a ruling suspending Robertson for the re-I maindcr pf.it meeting .for.rough .riding.
