M m Decide Soon on Whether To Appeal Green Ruling Ohio Commission to Make Known n Its Plans Within Next Few Days COLUMBUS, Ohio, May 13.— The State ie Racing Commission will reveal "within the ie next few days" whether it will appeal the te recent decision in the Henry Green case, e» William A. Carroll, assistant attorney gen-r l" eral, announced here today. Green was suspended for three years for allegedly barring a representative of the ie . commission from the money room at Hamilton last August. However, the ban was lifted by Judge Myron. Gessaman of the Franklin County * Common Pleas Court. Judge Gessaman held that the board did not possess the ie authority to suspend Green. When he first learned of Judge Gessa-mans " decision, chairman Zoltan Gombos _ said the board would appeal the ruling. Later, this announcement was withdrawn *J until Carroll could read the full opinion. In revealing that the commission would • make known its plans within the next few days, Carroll did not indicate what he would advise the board to do. - Meanwhile, Green, central figure in the squabble, is at his home in Shaker Heights, 1 Ohio. He hailed Judge Gessamans verdict with the statement: "Lam certainly glad - that justice was dealt out fairly. At no time have I ever done anything to injure . racing in the slightest. My one and only aim was to build it up in Ohio. In my 34 . years of affiliation with the sport, I have done that." Green recently announced his voluntary retirement from racing.
